Tracey Cohen, QC, is leading litigation and arbitration counsel. Tracey is recognized for her expertise in Corporate and Commercial Litigation, Securities Litigation and International and Commercial Arbitration. She has repeatedly been recognized as one of Canada’s top 25 female litigators and was named one of Canada’s top 50 trial lawyers in 2021.
She was appointed as Queen’s Counsel in 2015, admitted as a Fellow of the American College of Trial Lawyers in 2019, and as a Fellow of the Litigation Counsel of America in 2020. Tracey has been noted for her ability to strategize the best approach for complex disputes; as “very strong in developing relationships”; and for understanding her clients’ business and objectives.
Tracey’s breadth of practice includes class actions, shareholder disputes, family business disputes, internet litigation, privacy litigation, data breach, directors’ and officers’ liability, professional negligence, mining, tax, fraud, and securities (including regulatory matters before the BC Securities Commission and other securities regulators). She works with law firms in other jurisdictions to collaborate on cross-border litigation.
Tracey is a frequent speaker and contributor to legal education. She has spoken and written for Continuing Legal Education on various topics, including class actions, evidence, affidavits, and expert evidence. She has also presented in advocacy programs put on by the Advocates’ Society and the Canadian Bar Association. She has taught sections on opening and cross-examination for the trial advocacy course at the University of British Columbia’s Allard School of Law.
Tracey is a currently a member of Fasken’s Partnership Board, Chair of its National Arbitration Steering Committee and Co-Chair of its Commercial Litigation Group in BC.
