Plaintiff Class Action

Murielle Steven Walsh is a forceful advocate for equal rights and a mentor to women in the early stages of their careers. In over two decades at Pomerantz, she has successfully led high-profile cases involving #MeToo and other cutting-edge issues.

Murielle leads a securities class action against Wynn Resorts arising from its concealment of sexual misconduct by its founder and former CEO, Stephen Wynn, against the company’s female employees. In Wynn, Murielle seeks to expand the scope of securities laws by arguing that a company’s statements about its Code of Conduct may be actionable when the company engages in egregious violations of the Code. Such statements, long considered by courts to be mere puffery, have earned significance in the context of #MeToo. In May 2020, the court granted the defendants’ motion to dismiss, while granting Pomerantz leave to amend its complaint, which Murielle did. With the Second Amended Complaint filed, the court denied the defendants’ motion to dismiss in July 2021.

In a securities class action against Ormat Technologies, Murielle achieved a solid financial settlement for investors in January 2021. Ormat’s securities are dual-listed on the New York Stock Exchange and the Tel Aviv Stock Exchange. The Supreme Court’s 2010 Morrison decision seemed to sound a death knell for U.S. securities fraud claims predicated on stocks purchased abroad. Murielle persuaded the district court in Ormat to exercise supplemental jurisdiction in order to apply U.S. securities law to the claims in the case, regardless of where investors purchased their securities. This decision exponentially expanded global investor rights and has already been cited by district courts to support similar claims.

Murielle serves as a member on the Executive Committee of the Board of Trustees of the non-profit organization Court Appointed Special Advocates for Children of Monmouth County. Murielle serves on the Firm’s Anti-Harassment and Discrimination Committee and in the past, she served as a member of the editorial board for Class Action Reports, as a Solicitor for the Legal Aid Associates Campaign, on the Honorary Steering Committee of Equal Rights Advocates, and has been involved in political asylum work with the Association of the Bar of the City of New York.

Murielle was named a 2020 Plaintiffs’ Lawyer Trailblazer by the National Law Journal, an award created to “honor a handful of individuals from each practice area that are truly agents of change” and was also honored as a 2020 Plaintiffs’ Trailblazer by the New York Law Journal. Murielle was honored in 2019, 2020 and 2021 as a Super Lawyers® “Top- Rated Securities Litigation Attorney.” Lawdragon named her a Leading Plaintiffs’ Financial Lawyer from 2019 through 2021.
