David is a Partner who practices in BD&P’s dispute resolution and litigation department. He has particular focus on construction litigation and labour resolution.  


In the field of construction litigation, David acts for owners, general contractors, and subcontractors in the industrial, commercial, and institutional sectors of construction. He provides advice on all aspects of construction projects from the tender phase through to project closeout. At the early project stage, David’s practice includes drafting construction contracts, drafting supplemental conditions to standard form contracts, reviewing tender proposals for compliance, and providing advice on tender-related disputes. Thereafter, David provides advice on all legal issues associated with construction projects, including surety (performance, labour and material) bond disputes, delay claims, lost productivity claims, faulty workmanship claims, and lien claims. In addition, David has provided assistance on a number of construction-related insolvencies, including with respect to the intersection of creditor priorities between secured creditors, lien holders, sureties, and others. David is familiar with the pressures that clients in the construction industry face, including those arising from the need to maintain project schedules, ensure quality workmanship, and meet project budgets. David provides practical advice that enables his clients to risk assess their legal disputes, while still promoting and encouraging their ability to achieve business-oriented solutions.


In the field of labour law, much of David’s experience relates to the construction industry, and intersects with his practice above. However, he has represented clients in the retail, health care, and manufacturing sectors. David has a wide variety of labour experience, including representing clients during union-organizing certification drives, successor and common employer applications, unfair labour practices, and grievance arbitrations.


David has appeared before the Alberta, British Columbia and Saskatchewan Labour Relations Boards, and all levels of Court in Alberta, including the Court of Queen’s Bench and the Court of Appeal. He has also represented clients on matters for submission to the Supreme Court of Canada.
