Daniel Charest gets results for his clients in high-stakes litigation. His career reflects a history of big wins in the court room and high-profile settlement agreements. He achieves those results through a combination of smarts and daily hard work. Daniel understands that trust and accountability with his clients, plus a dedicated group of attorneys and paralegals, form the foundation of a strong legal team.

From international arbitrations in London to small-town courthouses, Daniel knows each victory—no matter the size—matters to the client. Daniel co-founded Burns Charest with the mission to form a team of dynamic attorneys from varied backgrounds who are motivated to get real results for their clients. And Burns Charest reflects that vision.

Daniel was recognized for his work as lead trial counsel in securing a landmark win for Houston-area property owners in the largest takings case in U.S. history. The U.S. Court of Federal Claims held the United States liable for flooding and property damage caused by the Army Corps of Engineers’ management of Houston-area reservoirs during Hurricane Harvey in 2017. The ruling allows more than 10,000 property owners to recover significant flood-damage compensation for their Fifth Amendment taking claim.

Daniel led the negotiations for a $52 million class action settlement with Facebook on behalf of a class of content moderators who were forced to watch disturbing content as part of their work. Besides monetary relief, the settlement provides for workplace safeguards and changes in policy to improve the safety of content moderators.

And Daniel served as trial counsel for a major oil-and-gas client during a successful international arbitration regarding drilling rights to deep-water offshore drilling blocks off the coast of Africa. The London arbitration resulted in a complete win for the client. Beyond that, Daniel has led successful arbitrations and trials on behalf of domestic commercial clients.

Among other awards and recognition, Daniel was selected by the Texas Lawyer as “2020 Lawyer of the Year,” the National Law Journal as a 2020 “Winning Litigator,” and by Best Lawyers in America for Commercial Litigation and Energy Law from 2017-2022.

He earned his law degree from Tulane University, where he graduated summa cum laude and served on the Tulane Law Review. He is admitted to practice in Texas, the District of Columbia, and the U.S. Virgin Islands, and federal and circuit courts across the country.
