Ben Reichard is a partner in Fishman Haygood’s Litigation Section. Ben enjoys a diverse practice, including securities arbitration, antitrust, environmental law and general commercial litigation. Currently, he heads the firm’s recently-established international arbitration practice.
Mr. Reichard’s international arbitration practice is centered in the area of investor-state arbitration. He is currently representing several commercial contractors in confidential arbitrations against sovereign nations arising out of multi-hundred-million dollar large-scale infrastructure and industrial development projects.
Mr. Reichard is also among the group of lead counsel for investors against five banks for aiding and abetting the $7 billion Ponzi scheme perpetrated by R. Allen Stanford. (Rotstain, et al. v. Trustmark National Bank, et al., Case No. 09-2384, United States District Court for the Northern District of Texas). He has also represented individual investors in third-party liability claims arising out of Ponzi schemes. (P.K. Scheerle, et al. v. Omni Bancshares, Inc., et al., Case No. 667443, Civil District Court for the Parish of Orleans; Marquette, et al. v. Pershing, LLC, FINRA Matter No. 11-0669). In other class action matters, he has recently served as counsel for class plaintiffs in a securities lending class action (Diebold et al v. Northern Trust Investments, N.A. et al., Case. No. 09-cv-1934, United States District Court for the Northern District of Illinois), an ERISA class action (The Board of Trustees of the City of Pontiac General Employees Retirement System et al v. Northern Trust Investments, N.A. et al., Case No. 09-cv-7203, United States District Court for the Northern District of Illinois), and an antitrust class action (In re Cox Enterprises Inc. Set-Top Cable Television Box Antitrust Litigation, Case. No. 12-md-02048, United States District Court for the Western District of Oklahoma).
Mr. Reichard has also represented banks and hedge funds in disputes ranging from accounting malpractice (Vault Global Opportunities, LP, et al. v. J.D. Clark & Co., et al., Case No. 650616, Supreme Court of the State of New York) to improper investment advice (Metropolitan Bank Group, Inc., et al. v. SunTrust Robinson Humphrey, et al., FINRA Matter No. 11-00237). And he often represents a wide range of clients in general commercial disputes.
