Benjamin Heidlage represents both individuals and corporations in contract, securities, and antitrust disputes in state and federal courts and arbitral tribunals. Ben’s recent matters include representing: Travelport in a dispute with lenders under a $3 billion credit agreement; PetSmart on a high-dollar dispute with lenders challenging certain liability management transactions under a $4.2 billion credit agreement; a government-owned investment fund AIMCo, and Wells Fargo Bank, N.A., as securities intermediary, in a series of cases against life insurers concerning improper Cost of Insurance rate increases, where hundreds of millions of dollars are at stake; and a MacAndrews & Forbes company in a jury trial involving a massive antitrust claim against News Corp. and its subsidiaries. 


Since joining Holwell Shuster & Goldberg, Ben has also been heavily involved in the firm’s representation of banks as trustees or securities administrators in various RMBS “putback” matters, each involving hundreds of millions of dollars, including as a member of the team representing the trustees as lead trial counsel in the Lehman bankruptcy resulting in a favorable $2.4 billion award. Ben was also a member of the HSG team involved in a New York-based arbitration involving a commercial dispute between Japanese and Mexican parties. 


Previously, he has represented clients in the financial and technology sectors in antitrust matters pending in foreign and domestic tribunals. He has also represented a client at trial and on appeal in a case involving one of the largest CERCLA sites in the country. Ben has played a significant role in multiple shareholder disputes brought in connection with mergers and acquisitions, litigating issues including the fiduciary duties of company directors and officers and required disclosures. 


Ben has dedicated significant pro bono time to immigration matters. He was promoted to partner in January 2018 and has been named to Benchmark Litigation’s Under 40 Hot List since 2018. Before joining HSG in 2014, he was an associate at Cravath, Swaine & Moore and clerked for Judge Patrick Higginbotham of the U.S. Court of Appeals for the Fifth Circuit. He is a past recipient of the New York University Law Review Alumni Association Award.
