In a high-stakes patent invalidation action, the team represented the plaintiff Biocon against Sanofi before the High Court. The firm advised and provided patent infringement and validity analysis to the client prior to filing court action to invalidate Sanofi’s patent. The case is ongoing before the IP High Court.
The team successfully acted for Honda Motor in two copyright infringement matters relating to its Ex5 motorcycle. The defendants are MForce Bike Holdings & Malaysian Formula Bikes and Demak Corporation. This case shines a spotlight on the law concerning copyright protection for ‘artistic works’ in 3-dimensional forms. It also highlights to what extent the plaintiff must prove that the 3-dimensional work is produced from the 2-dimensional artistic drawings to be able to claim protection under the copyright regime for old artistic works.
The team continues to act for Public Performance Malaysia and its sound recording member companies in copyright disputes and matters involving their copyrighted works, including a number of ongoing cases in courts throughout Malaysia on breach of copyright licenses and an ongoing copyright infringement suit in the IP High Court.
